This two-day introductory course provides Local Public Agencies (LPAs) with a working knowledge of Federal requirements and procedures for acquiring property for Federally-assisted transportation projects. The course focuses on applying the Uniform Act and related Federal Regulations to specific situations and issues. Designed as a hands-on, highly interactive learning experience, instructors guide participants through a series of right-of-way (ROW) problem solving exercises and large group discussions. We encourage those with limited ROW knowledge to register for the free NHI 141045 web-based training course in advance of this instructor-led course session.

OUTCOMES:

Upon completion of the course, participants will be able to:

  • Explain the legal basis for land acquisition by a governmental entity
  • Assess the impact of a roadway improvement as it relates to the Uniform Act
  • Sequence the right-of-way process (ROW) within the overall project development process
  • Determine the appropriate valuation process for ROW acquistion
  • Apply the Uniform Act requirements for ROW acquisition
  • Apply the Uniform Act requirements to relocation assistance
  • Determine the agency's responsibilities for managing real property
Instructors
Lisa Barnes, Vice President of Training and Development of O. R. Colan Associates, has more than 20 years of experience in the area of right-of-way and has led the training division of ORC since 2005.  She led the teams involved in several NHI course developments and major updates including NHI Course 141029 Basic Relocation, NHI Course 141030 Advanced Relocation, NHI Course 141031 Business Relocation, and NHI Course 141050 Introduction to Federal-Aid Right-of-Way Requirements for Local Public Agencies.  She also instructs these courses.  Ms. Barnes is a Certified Instructor for NHI and was recognized as an NHI Instructor of Excellence for 2009.  She has been a Certified IRWA Instructor since 1995 and is approved to teach all IRWA relocation courses.  Ms. Barnes served on an IRWA task force that developed and presented nationwide seminars related to the 2005 revisions to the Uniform Act regulations at 49 CFR Part 24. 

Ms. Barnes is a Phi Beta Kappa graduate of Florida State University with a B.A. degree in English.  She is Licensed Florida Real Estate Broker and Licensed Florida Real Estate Instructor.  She previously served as the Chair of the IRWA International Relocation Committee and received the SR/WA designation and R/W-RAC certification from the IRWA.  Ms. Barnes served as a Judge for FHWA’s Excellence in Right-of-Way Awards in 2010.

Robert Merryman, Senior Vice President of O. R. Colan Associates, is one of the most knowledgeable right-of-way professionals in the industry.  He has more than 30 years of experience, and is recognized as one of the nation’s foremost authorities on land acquisition and relocation programs under the Uniform Act.  He has been involved in the acquisition and relocation of thousands of parcels for numerous agencies.

Mr. Merryman has both developed and instructed a number of courses on the subject of relocation.  He instructs the National Highway Institute (NHI) courses on Basic Relocation, Advanced Relocation, and Business Relocation.  He is a co-author of NHI’s Introduction to Federal-Aid Right-of-Way Requirements for Local Public Agencies.  He led a Retrospective Study of Business Relocation Payments and developed a videotape on Concepts in Comparable Replacement Housing.  He is currently working on a Business Relocation Assistance Retrospective Study for FHWA.
 
Mr. Merryman received a Bachelor’s degree in Business Administration from the University of Missouri.  He is a Certified Instructor for both the NHI and International Right-of-Way Association (IRWA), and is a licensed Real Estate Appraiser in Missouri.  He serves on the Relocation Committee of the IRWA and has received the R/W-RAC certification from the IRWA.  Mr. Merryman is also an associate member of the Appraisal Institute.  Mr. Merryman was an NHI Instructor of Excellence for 2007 and 2009.

Who Should Attend?

This course is intended for those within local public agencies who are responsible for acquring right-of-way for federally-funded projects, as well as those responsible for oversight of LPAs, in addition to FHWA personnel, consultants, Federal and State staff and other interested parties.

Contact Hours: 12.0. For purposes of the VA DPOR continuing education requirements for Virginia Professional Engineer license holders this workshop earns 14.4 continuing education credits.

Registration fees for all employees of VDOT and Virginia local government agencies will be paid for by the VDOT Learning Services Center budget. The registration fee for all others is $400/per attendee. The fee covers the session, all course materials, and meals.

Special Registration Instructions for Employees of the Virginia Department of Transportation

U.Va. TTA workshop registration fees and related expenses for all employees of VDOT will be paid from the VDOT Learning Center budget. U.Va. TTA will direct bill the VDOT Learning Center for workshop registration fees. However, registrants need to contact their District Training Office or the VDOT Learning Center (Central Office employees) for instructions on how to seek reimbursement for travel expenses. Please also note it is not sufficient to enroll in a U.Va. TTA workshop through the VDOT Virtual University. VDOT registrants must also complete and submit a U.Va. TTA registration form to the U.Va. TTA office.

Due to current travel restrictions, VDOT employees are strongly encouraged to attend U.Va. TTA workshops on a day trip basis. Overnight travel requires permission from your District Administrator or Chief -- and in some cases higher levels of authority. If you require overnight lodging to attend a U.Va. TTA workshop, consult with your supervisor, District Training Manager, or VDOT Learning Center on travel approval procedures.
